Introduction
Welcome to Opulence Signature, our premium concierge membership program. These Terms of Service (“Terms”) outline the terms and conditions governing the use of Opulence Signature services.
By becoming an Opulence Signature client, you agree to abide by these Terms. Please read them carefully.
1. Definitions
1.1. “We,” “Our,” “Us”: Refers to Opulence Lifestyle Management, Inc.
1.2. “Client”: Refers to individuals or entities who engage in Opulence Signature services.
1.3. “Services”: Refers to the range of concierge services provided under Opulence Signature.
2. Scope of Services
We offer remote, and at times, in-person lifestyle management and concierge services. These services include but are not limited to restaurant reservations, travel planning, relocation services, personal shopping, ticketing to events, event planning, real estate referring, and more.
3. Client Obligations
3.1. Accurate Information: Clients must provide accurate and complete information necessary for the provision of services.
3.2. Compliance with Laws: Clients agree to comply with all applicable laws and regulations.
3.3. Expense Responsibility: Clients are responsible for all costs, fees, deposits, and expenses incurred through the Services, whether billed directly by Opulence or by third-party providers.
4. Service Fees, Membership, and Payment
4.1. Pricing: Details of our most current pricing structure will be provided upon request.
4.2. Payment: Opulence Lifestyle Management accepts payments via credit or debit card, bank transfer, and wire transfer. Payments made by credit card may be subject to processing fees, which are the responsibility of the Client.
4.3. Membership: All Opulence Signature memberships cover one full calendar year, at minimum, and may be extended if both parties agree. Memberships are no shorter than one calendar year unless otherwise noted and agreed upon prior to registration.
4.4. Refunds: Service and membership refunds are not applicable under any circumstances. Refunds for goods and services outsourced to third-party providers will be processed to the best of our ability, subject to the provider’s policies.
5. Third-Party Providers
Opulence Lifestyle Management may engage independent third-party vendors, suppliers, and service providers (“Third-Party Providers”) in connection with Opulence Signature. All arrangements with Third-Party Providers are made directly between the Client and such providers. Opulence is not responsible for the acts, omissions, or negligence of Third-Party Providers and makes no representations or warranties regarding their services.
6. Confidentiality and Privacy
6.1. Confidentiality: Opulence Lifestyle Management will maintain strict confidentiality regarding all client information.
6.2. Privacy: Our Privacy Policy, available on our website, outlines our approach to data protection and privacy.
7. Limitation of Liability
Opulence Lifestyle Management is not liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use Opulence Signature services, or from the acts, omissions, or failures of any Third-Party Providers.
8. Indemnification
The Client agrees to indemnify, defend, and hold harmless Opulence Lifestyle Management, its officers, employees, and affiliates from and against any and all claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to the Client’s use of Opulence Signature, including those resulting from Third-Party Providers.
9. Force Majeure
Opulence Lifestyle Management shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, governmental actions, terrorism, wars, power outages, or failures of suppliers or communications systems.
10. Referral Program
We are pleased to offer a referral program to our valued clients as a token of appreciation for your trust and support. Given that the structure may change from time to time, the most up-to-date information on our referral program will be provided upon request.
11. Termination of Services
We reserve the right to terminate services for any client at our discretion, without prior notice. Early termination of a membership, by either the client or Opulence Lifestyle Management, will result in payment of any outstanding amounts remaining on the membership, as well as any outstanding servicing bills, in full within thirty (30) days of cancellation.
12. Intellectual Property
All content and materials provided by Opulence Lifestyle Management remain the property of Opulence Lifestyle Management.
13. Dispute Resolution
Any disputes arising out of or in connection with these Terms will be resolved through arbitration in accordance with the American Arbitration Association’s rules. Notwithstanding the foregoing, Opulence may seek injunctive or equitable relief in court to protect its intellectual property, confidentiality, or payment rights.
14. Modification of Terms
We reserve the right to modify these Terms at any time. Notice of modifications will be provided through email. Continued use of Opulence Signature constitutes acceptance of the updated Terms.
15. Communication Opt-In
By registering as an Opulence Signature client, you consent to receiving communications from us via email, text messages, and our proprietary communication platform, OpuLink. These communications may include but are not limited to service updates, special offers, event notifications, and account-related information. You understand that these messages are an integral part of the services we provide, and by opting in, you agree to maintain current and accurate contact information to ensure seamless communication. You may manage your communication preferences at any time by contacting our support team.
16. Governing Law
These Terms will be governed by and construed in accordance with the laws of New York.
17. Entire Agreement
These Terms constitute the entire agreement between Opulence Lifestyle Management and the Client with respect to Opulence Signature and supersede all prior agreements and understandings.
By proceeding with your Opulence Signature membership, you acknowledge that you have read, understood, and agreed to these Terms of Service.
